Decision Posture Assessment Services

These Terms and Conditions govern the provision of Decision Posture Assessment services provided by Styperson Pope Limited, trading as The Decision Arc (“we”, “us”, “our”) to the purchasing organisation (“Client”, “you”, “your”).

By placing an order for the Decision Posture Assessment, you agree to be bound by these Terms and Conditions.


1. Service Description

1.1 The Decision Posture Assessment comprises:

  • An anonymous online assessment completed by individual team members
  • Analysis of aggregated response data
  • A Decision Posture Map depicting the team’s distribution across eight Decision Postures
  • Decision Practices tailored to the team’s identified Decision Posture patterns

1.2 The assessment is designed for decision-making teams that have worked together long enough to have developed observable patterns. It is not suitable for newly formed teams.

1.3 Assessment responses are anonymous. Individual responses cannot be identified, attributed, or provided separately.


2. Ordering and Payment

2.1 Orders are placed by submitting the order form with the required organisational details.

2.2 We will provide an invoice following receipt of your order.

2.3 Payment must be received in full before we begin the analysis.

2.4 Pricing is as stated at the time of order and is independent of the number of team members completing the assessment.

2.5 All prices exclude VAT or equivalent sales taxes where applicable. VAT will be added to invoices in accordance with prevailing law.


3. Assessment Process

3.1 Upon receipt of an order, we will provide a secure assessment link for distribution to your team members.

3.2 You are responsible for distributing the assessment link to appropriate team members and advising us of the total number (if different from the order details provided)

3.3 Each team member completes the assessment individually and anonymously.

3.4 On receipt of payment in full, or completion of the final assessment, (whichever is later) we will begin the analysis and will deliver the Decision Posture Map and Decision Practices approximately one week later.

3.5 If assessments remain incomplete for more than 90 days from the date the assessment link is provided, we reserve the right to proceed with analysis based on responses received to that point.


4. Data Collection and Privacy

4.1 Client Data

We collect the following information from you when you place an order:

  • Organisation name
  • Contact person’s name and email address
  • Billing address
  • Purchase order number (if applicable)

This information is used solely for:

  • Invoice preparation and payment processing
  • Delivery of the Decision Posture Map and Decision Practices
  • Communication regarding the assessment and its results

4.2 Assessment Response Data

4.2.1 Assessment responses are collected anonymously. We do not track:

  • Individual respondent identities
  • IP addresses
  • Device identifiers
  • Email addresses

4.2.2 The only identifying information collected from respondents is:

  • The name of the decision team being assessed (as entered by the respondent)
  • Whether the respondent is a member of the team or an observer

4.2.3 This information is used solely to:

  • Group responses by team
  • Analyse patterns across the team as a whole
  • Generate the Decision Posture Map and Decision Practices

4.2.4 Assessment data is not evaluated at an individual level. The assessment does not identify, evaluate, or make any determinations about individuals.

4.3 Data Retention

4.3.1 Client contact and billing information is retained in accordance with applicable accounting and tax requirements.

4.3.2 Aggregated, anonymised assessment data may be retained for the purpose of improving the Decision Posture Assessment methodology and framework.

4.3.3 No data is retained that could identify individual respondents or link specific responses to individuals.

4.4 Data Processing

Assessment data may be processed using third-party services (including Google Forms or equivalent survey platforms) that comply with appropriate data protection standards.

4.5 Your Rights

You have the right to:

  • Request information about what data we hold relating to your organisation
  • Request correction of inaccurate data
  • Request deletion of your organisational data (subject to legal retention requirements)

4.6 Data Protection Compliance

We process data in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.


5. Confidentiality and Intellectual Property

5.1 Confidentiality of Outputs

5.1.1 The Decision Posture Map and Decision Practices prepared for you are confidential to your organisation.

5.1.2 We will not disclose your Decision Posture Map, Decision Practices, or any analysis specific to your team to any third party without your prior written consent.

5.1.3 We may use aggregated, anonymised data and general insights from assessments (across multiple clients) for research, methodology development, and general marketing purposes, provided no individual client or team can be identified.

5.2 Client Confidentiality Obligations

5.2.1 The Decision Arc framework, methodology, and analytical approach are our proprietary intellectual property.

5.2.2 You may use the Decision Posture Map and Decision Practices internally within your organisation for the team assessed.

5.2.3 You may not:

  • Provide the assessment, framework materials, or Decision Practices to third parties, without our prior written consent
  • Use the assessment or materials for commercial purposes beyond your own internal use
  • Reproduce, adapt, or reverse-engineer the assessment methodology
  • Present the materials as your own work or methodology

5.3 Intellectual Property Ownership

All intellectual property rights in the Decision Arc framework, assessment methodology, Decision Posture definitions, analytical approach, and template Decision Practices remain our property.

Your Decision Posture Map and the specific analysis provided to you may be used freely within your organisation.


6. Limitations and Disclaimers

6.1 The Decision Posture Assessment is an analytical tool designed to support governance and decision-making improvement. It is not:

  • A psychological assessment of individuals
  • An evaluation of team member competence or capability
  • A guarantee of specific outcomes or improvements

6.2 Decision Practices are recommendations based on common patterns associated with Decision Postures. They require adaptation to your specific context, culture, and circumstances.

6.3 Implementation of Decision Practices is at your discretion and risk. We are not liable for outcomes arising from implementation or non-implementation of Decision Practices.

6.4 The assessment requires honest, considered responses from team members. We cannot guarantee accuracy if responses do not reflect actual team behaviour.

6.5 We provide the assessment and analysis in good faith based on established methodology. However, we make no warranties, express or implied, regarding:

  • The suitability of the assessment for your specific circumstances
  • The completeness or accuracy of any patterns identified
  • The effectiveness of Decision Practices in your specific context

7. Limitation of Liability

7.1 Our total liability to you under or in connection with these Terms and Conditions, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the fees paid by you for the assessment.

7.2 We shall not be liable for any indirect, consequential, or economic losses, including loss of profits, business, revenue, goodwill, or anticipated savings.

7.3 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.


8. Cancellation and Refunds

8.1 You may cancel your order at any time before payment is made.

8.2 Once payment has been received and the assessment link provided, the service is considered commenced and fees are non-refundable.

8.3 If you do not distribute the assessment link or team members do not complete assessments within 90 days, no refund will be provided.

8.4 In exceptional circumstances (for example, if we are unable to deliver the service due to factors within our control), we will provide a full refund of fees paid.


9. General

9.1 Entire Agreement

These Terms and Conditions, together with the order form and invoice, constitute the entire agreement between you and us regarding the Decision Posture Assessment.

9.2 Amendments

We reserve the right to update these Terms and Conditions. The version in effect at the time you place your order will govern that order.

9.3 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.4 Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
